MINUTES

Mr. Sandler (Chairman) called the meeting to order at 7:00 PM.
Lot Release Request - Definitive Subdivision
CASE PB#1997-1A - JOHN & MAURA DUNN, 23 Schoefield Road, Cohassett, MA 02025, requests partial releases for Lots 3 & 4 located on Brittany’s Way.
Chet Lay (Surveyor) presented the request for a partial release from the Covenant of Brittany’s Way for Lots 3 and 4. Mr. Lay noted that the sub-grade, drainage and first pavement course have all been installed as per plan. Mr. Lay also presented a revised plan indicating changes to
sidewalks for wheelchair access as required by the State.
A MOTION was made by Mr. Cole and seconded by Mr. Holland to accept the modified plan as submitted. VOTE: Unanimous (6-0): For: Sandler, Abbott, Cole, Holland, Nightingale and Morse
A MOTION was made by Ms. Morse and seconded by Mr. Holland to release Lots 3 and 4 from the Covenant of Brittany’s Way. VOTE: Unanimous (6-0): For: Sandler, Abbott, Cole, Holland, Nightingale and Morse
Approval Not Required:
CASE PB#2004-23 – GOOD LUCK COTTAGES NOMINEE TRUST - DONALD CONNELLY & DENIS CREMINS TRUSTEES, 5755 State Highway, North Eastham, MA - Map 02 Parcels 058.
Bob Freeman (Surveyor) presented an overview of the request to reconfigure existing lot to create six (6) new lots. The Board discussed a response from Town Counsel on the plan.
A MOTION was made by Ms. Morse, seconded by Mr. Nightingale to endorse the ANR plan.
VOTE: Unanimous (6-0): Sandler, Abbott, Cole, Holland, Morse, and Nightingale
Mr. Klink recused himself from deliberating on Case PB#2004-07
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-07 - WALTER & MARY MAKAR, 60 Pleasant Street, Berlin, MA 01503, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV to construct new two-story residential dwelling resulting in a Site Coverage Ratio exceeding 15% of the lot area for property located at 220 Pierce Road, Eastham, Map 04 Parcel 526.
The Applicant’s Attorney sent in a letter requesting a continuance for two months.
A MOTION was made by Ms. Morse, seconded by Mr. Holland to continue hearing to September 8, 2004. VOTE: Unanimous (6-0): For: Sandler, Abbott, Cole, Holland, Morse, and Nightingale
Mr. Klink rejoined the Board.
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-14 - RENEE & STUART ROTHMAN, 60 Ober Road Newton, MA. 02459, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to add screen porch, sunroom and stairway to an existing dwelling resulting in a Site Coverage Ratio exceeding 0.15 for property located at 14 Gile Road, Eastham, Map 07 Parcel 538.
Duane Landreth (Attorney) provided an overview of the landscape plan submitted for the project. Peter Fenn (119 Bay Road) expressed concerns that the plan does not meet the requirements of Residential Site Plan Approval. The Board discussed the need for a more detailed landscape plan that includes a slope detail and revised building plans showing the enclosed porch without a sunroom on top. The Board reminded the Applicant’s representative that no approvals for work have been given by the Planning Board. Attorney Landreth requested a continuance to develop the requested plans.
A MOTION was made by Mr. Cole, seconded by Mr. Holland to continue hearing to August 11, 2004 with plans to be submitted by August 3, 2004. VOTE: Unanimous (6-0) For: Sandler, Abbott, Cole, Holland, Morse, and Nightingale
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-15 - MICHAEL SARCIONE, 28 Dorothy Road, Millbury, MA 01527, requests Residential Site Plan Approval Under Eastham Zoning By-Laws Section XIV, to demolish existing structure and construct a new dwelling resulting in Site Coverage exceeding 3,000 sq. ft. for property located at 50 Ellen Drive, Eastham, Map 04 Parcel 346.
Jerry Tobin (Builder) presented an overview of the landscape plan submitted for the Board’s approval. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse and SECONDED by Mr. Cole to APPROVE - Site Plan Approval-Residential based upon landscape plan submitted for CASE PB#2004. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. VOTE: Unanimous (6-0) For: Sandler, Abbott, Cole, Holland, Morse, and Nightingale
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-11 - LAUREEN KUNCHES & PATRICIA A. JOYCE, 47 Maple Street, Milton, MA 02186, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV to demolish an existing dwelling and construct a new two-story residential structure, resulting in a Site Coverage Ratio exceeding 15% of the lot area for property located at 26 Bayberry Lane, Eastham, Map 13 Parcel 165.
Thomas Moore (Architect) provided an overview of the revised project reducing the overall size of the requested project. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse and SECONDED by Ms. Abbott to APPROVE - Site Plan Approval-Residential based upon revised house plans submitted for CASE PB#2004-11. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws.

New Hearing - Residential Site Plan Approval
CASE PB#2004-19 - NANCY L. MACRIS, 724 Olde Point Road, Hampstead, NC 28443, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to construct a guest house(1375 sq. ft.), expand an existing structure by adding 650 sq. ft., and replace an existing barn (625 sq. ft.), resulting in Site Coverage greater than 3,000 sq. ft. for property located at 1750 Nauset Road, Eastham, Map 09 Parcel 405.
John Macris (Applicant) provided an overview of his request. The Board discussed concerns with his project meeting the zoning requirements of District F including exceeding square footage and proposed second dwelling (guest house). The Chair asked for public comment on this request and there was none. Mr. Macris requested a continuance to the next meeting to review his request.

New Hearing - Residential Site Plan Approval
CASE PB#2004-20 - LAURENCE & VIVIAN PERRY, PO Box 1193, Eastham, MA 02642, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to construct three season room (12' X 16') resulting in Site Coverage greater than 3,000 sq. ft. for property located at 835 Hay Road, Eastham, Map 14A Parcel 04
Larry Perry (Applicant) provided an overview of the project to add a three season room. reducing the overall size of the requested project. The Chair asked for public comment on this request and there was none.
A MOTION was made by Mr. Holland and SECONDED by Ms. Morse to APPROVE - Site Plan Approval-Residential for CASE PB#2004-20. The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws. New Business - Preliminary Subdivision
CASE PB#2004-21 - G. DONALD FIFE TRUST; JONATHAN D. & TIMOTHY H. FIFE, 4520 Sherwood Forest, Delray Beach, FL 33445, requests Preliminary Subdivision Plan Approval to reconfigure two existing lots (5.60 acres) into five lots (four new building lots) for property located at 125 & 145 Lawton Road, Eastham, Map 14 Parcels 48 & 52.
Peter Soule (Surveyor) presented an overview of the proposed subdivision and handling of drainage. Vincent Yokabaskas (100 Lawton Road) raised concerns with frontage along Lawton Road. Anne Macaulay (45 Heritage Hill Circle) asked if road would connect with Heritage Hill Circle.
A MOTION was made by Mr. Holland and seconded by Ms. Morse to approve the Preliminary Subdivision Plan with the Rural Road Alternative as submitted. VOTE: Unanimous (6-0): Sandler, Abbott, Cole, Holland, Nightingale and Morse
Mr. Cole recused himself from deliberating on Case PB#2004-02
Plan Change – Site Plan Approval – Special Permit:
CASE PB#2004-02 - SEAMAN’S BANK/LESTER J. MURPHY, Jr., 221 Commercial Street, Provincetown, MA 02657, discussion of proposed plan changes for approved bank facility on property located at 4355/4365 State Highway and Old County Road, Eastham, Map 08 Parcels 145A&B.
Jay Murphy (Attorney) and Kurt Raber (Architect) provided an over of requested plan changes.
A MOTION was made by Ms. Morse and seconded by Mr. Holland to make a Finding of Fact that proposed plan changes are minor in nature and to accept the revisions as presented.
VOTE: Unanimous (5-0) For: Sandler, Abbott, Cole, Holland, Nightingale and Morse
Mr. Cole rejoined the Board.
Other Business
Zoning Working Meetings – The Board discussed the need to add a monthly Work Session to discuss needed zoning changes in preparation of upcoming Town Meetings. The Board set its first work session for July 20, 2004 @ 7:00 PM in Town Hall.
Approval of Minutes:
A MOTION was made by Ms. Morse, seconded by Mr. Cole to accept the minutes of the June 9, 2004 meeting as drafted. VOTE: Unanimous (6-0): Sandler, Abbott, Cole, Holland, Nightingale and Morse
